Shootin’ From The Hip Give-Away Official Rules

 

1. NO PURCHASE NECCESARY TO ENTER, WIN, OR CLAIM A PRIZE in this sweepstakes. A purchase or payment will not increase your chance of winning.

 

1. SPONSORS: The Shootin’ From The Hip Give-Away (“Sweepstakes”) is sponsored by Mavrik Joos, Mavrik, Inc., Meathouse Inc., Meathouse Outdoors LLC and Pure Fishing, Inc. (collectively, the “Sponsors”), located at PO Box 232, Duluth, MN 55801.

 

1. ELIGIBILITY: The Sweepstakes is open to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years or older at time of entry. Employees of Sponsor, and any of their respective owners, parent companies, affiliates, directors, subsidiaries, franchisees, representatives, advertising, promotion and production agencies involved in this Sweepstakes (collectively, the “Sweepstakes Entities”), and their immediate family members (i.e., spouses, parents, children and siblings, regardless of where they reside) and/or persons living in the same household of each (whether or not related thereto) are not eligible to participate in the Sweepstakes. Void where prohibited or restricted by law. All federal, state and local laws apply. Participation constitutes a Participant’s full and unconditional agreement to these Official Rules and Sponsors’ decisions, which are final and binding in all matters related to the Sweepstakes.

 

1. SWEEPSTAKES PERIOD: Sweepstakes begins at 12:00 am Central Time (“CT”) on December 2, 2024, and ends at 11:59 pm CT on December 20, 2024 (the “Sweepstakes Entry Period”). All dates and times andF CT. This Sweepstakes consists of three (3) “Third Prizes”, two (2) “Second Prizes”, one (1) “First Prize”, and one (1) “Grand Prize” (collectively, the “Prizes”). Each Prize will be awarded through a random drawing following the Sweepstakes Entry Period.

 

1. HOW TO ENTER: Entrants may enter the Sweepstakes by one of the following methods: (i) automatically, with each purchase made through www.mavoutdoors.com; or (ii) by mail, by printing their full name, age, address, phone number, and email address on a 3” x 5” card and mailing it to: Mavrik Inc., Attn: Mav’s Shootin’ From The Hip Give-Away, PO Box 232, Duluth MN 55801 (a “Mail Entry”). Mail-in entries must be delivered prior to the end of the Sweepstakes Entry Period to be eligible.

 

By submitting an Entry, the Entrant agrees to and accepts these Official Rules. No purchase necessary to enter or win. Limit one (1) entry per person; multiple entries will not increase chances of winning and may result in Entrant’s Entry being filtered out and/or disqualified and declared null and void in Sponsor’s sole discretion. All entries must be received by the Sweepstakes Period deadlines provided above. Entrants assume all risk of lost, late, misdirected, incomplete, or illegible entries. Each winner may only win one (1) Prize. Sponsor reserves the right to withdraw or cancel the Sweepstakes at any time without notice if it becomes technically corrupted, including if a computer virus or system malfunction inalterably impairs its ability to conduct the Sweepstakes, or upon any unanticipated occurrence that is not fully addressed in these Official Rules. In the event of cancellation, Sponsor reserves the right to randomly select the Grand Prize winner from among all eligible, non-suspect entries received up to the time of such cancellation, and in a manner determined by Sponsor to be fair, appropriate, and consistent with these Official Rules. Sponsor reserves the right to award fewer than the stated number of prizes in the event that it cannot confirm the stated number of winners in accordance with these Official Rules.

 

Any attempt by any individual to submit more than one entry multiple names or email addresses or any other methods will void all of such individual’s prior entries for Prizes in Sponsor’s sole discretion. Entrants and/or potential winners may be required to provide proof of identification and eligibility as required by Sponsor. If there is a dispute as to the identity of an Entrant or Sponsor is unable to verify the identity or eligibility of an Entrant, the entry will be deemed ineligible, and the Sponsor reserves the right to withdraw any such Prize, re-draw, and award the Prize to a new winner determined in Sponsor’s reasonable discretion. All received entries and data submitted in connection therewith become the property of Sponsor and will not be acknowledged or returned.

 

1. PRIZES: The drawing for the Prizes will occur within twenty-four (24) hours of the conclusion of the Sweepstakes Entry Period (the “Drawing Date”) where three (3) winners will be awarded a $100 MavOutdoors.com gift card/code, two (2) winners will be awarded a $200 MavOutdoors.com gift card/code, one (1) winner will be awarded a $500 MavOutdoors.com gift card/code, and one (1) Grand Prize winner will be awarded an expenses-paid trip to fish with Mavrik Joos in Duluth, Minnesota. The approximate retail value of the Third Prizes, Second Prizes, and First Prizes are the face value of the gift card/codes, and the approximate retail value of the Grand Prize is $3,000.00.  The Grand Prize includes: (a) one (1) round trip coach class air transportation from a major commercial airport with regularly scheduled commercial flights close to winner’s primary residence (as determined by Sponsor, in its sole discretion; (b) two (2) nights at a Sponsor-affiliated lodging accommodation; (c) a gift bag of products from MavOutdoors.com; and (d) one (1) day of fishing with Mavrik Joos at a lake of his choice in or around Duluth, MN.

 

Transportation is not included if winner resides within 300-mile radius of Duluth, MN, and if winner resides outside of the contiguous 48 United States, airfare will only include costs from Los Angeles International Airport or such other major metropolitan airport within the contiguous 48 United States to Duluth, MN, and the winner will be responsible for any and all costs to travel to reach the major metropolitan airport within the contiguous 48 United States. Any other costs and expenses associated with Grand Prize acceptance not specifically mentioned herein are not included and are solely the winner’s responsibility, including but not limited to: baggage fees, taxes, food and beverages, gratuities and tips, insurance, parking, and travel to and from the airport. Flights and lodging are subject to availability, certain restrictions and blackout dates apply. Airline carrier and lodging regulations and conditions apply. Sponsor is not responsible for any flight delay/cancellation, and not liable for any expenses incurred as a consequence of such delay/cancellation. If winner is unable to travel for any reason after the trip is booked, winner forfeits the Grand Prize in its entirety and the Sponsor shall have no further obligation to the winner. Winner must complete and return a Liability/Publicity/Travel Release prior to travel.

 

All Prizes are subject to availability, and subject to change or cancellation without written notice or warning. Should a Prize or a portion of a prize becomes unavailable, Sponsor shall make reasonable efforts to provide winner with item of a similar nature or value for that portion of the Prize that is not available. If no substitute prize is reasonably available then the remaining components, if any, of the Prize shall constitute full satisfaction of Sponsor’s Prize obligation to winner, and no other substitution or compensation will be awarded. Please note that any public location where people are present provides an inherent risk of injury, and entrant accepts and assumes any and all such risk and releases Sponsor and any affiliates from and against the same.

 

All winners acknowledge that the Sponsor (and all other businesses concerned with this Sweepstakes) and its agents do not make, nor are in any manner responsible for, any warranty or representations, expressed or implied, in fact or in law, relative to the quality, conditions, fitness or merchantability of any aspect of any Prize. All Prizes are non-transferable, non-returnable, non-refundable and non-assignable, and must be accepted as awarded, “AS IS”, with no warranty, representation or guarantee, express or implied, in fact or in law, made by Sponsor or for which Sponsor may be liable. Sponsor shall not be responsible for any cancellations or delays or any act or omissions whatsoever by any other persons providing any of the Prize fulfillment services or by the vendor or transportation company. The Sponsor is not responsible for any returned/undeliverable Prizes and such Prizes will be forfeited.

 

All trademark, intellectual property, and other rights in connection with the Sweepstakes and Prizes are expressly reserved by their respective owners. The approximate retail value of all Prizes are subject to price fluctuations in the consumer marketplace based on, among other things, any gap in time between the date the approximate retail value is estimated for purposes of these Official Rules and the date the Prize is awarded or redeemed. Any difference between the stated approximate retail value of any of the Prizes and the actual value will not be awarded.

 

1. PRIZE AND ODDS OF WINNING: Winners will be selected by random drawings upon conclusion of the Sweepstakes Entry Period stated above. The Prizes’ descriptions and quantities are stated above. The number of winners corresponds to the quantity of Prizes. The Prizes are as specifically listed above. The odds of winning the Prizes are dependent upon the number of eligible entries. The random drawing and awarding of the Prizes will be conducted under the supervision of Sponsors whose decision is final and binding in all matters pertaining to this Sweepstakes. Entrants agree to be bound by these Official Rules as a condition of entering the Sweepstakes.

 

1. VERIFICATION OF POTENTIAL WINNERS: Receiving a prize is contingent upon a potential winner’s compliance with these Official Rules. Sponsor’s decisions as to the administration and operation of the Sweepstakes and the verification of winners are final and binding in all matters related to the Sweepstakes.

 

The Prize drawings will be conducted on or about December __, 2024, from among all eligible entries received during the Sweepstakes Entry Period. Potential Prize winners will be notified by email at the email address provided at time of entry. Potential Prize winner swill be required to complete and return such documents and provide verification as reasonably requested by Sponsor within seven (7) days of date specified on notification in order to formally claim and receive the Prize. If not returned within the date specified on the notification, or if a potential Prize winner is otherwise found to be ineligible, or if a potential winner cannot travel on the dates designated by the Sponsor, or if a potential Prize winner cannot accept/receive the Prize for any reason, that potential Prize winner will be disqualified and an alternate potential Prize winner will be notified. Attempts will be made to contact and/or verify up to four (4) alternate potential Prize winners. After four (4) attempts to verify a Prize winner fail, or if the Prize is not claimed by January 31, 2024, the prize will not be awarded. Grand Prize winner will be required to furnish his/her/their Social Security number to the Sponsor as a condition of receiving the prize, and an IRS Form 1099 will be filed in the name of the winner for the total value of the Prize. All federal and state taxes, if any, are the sole responsibility of each winner.

 

By participating and accepting a Prize, where permitted by law, each winner grants to Sponsors (and agrees to confirm that grant in writing) and those acting pursuant to the authority of Sponsors or as their designee or licensee, the right to record, print, publish, broadcast, use, create derivative works from, reproduce, distribute, display, perform, and modify worldwide in any medium now known or hereafter developed, including but not limited to the World Wide Web, social media, or streaming, at any time(s), the winner's name, portrait, picture, voice, likeness, city and state of residence, biographical information, and other information and content provided in connection with the Sweepstakes as news or information and for advertising, promotional, trade, commercial, and publicity purposes without additional compensation or review. By submitting an Entry, Entrant consents to the collection and sharing of certain data submitted to Sponsors, which may include, but is not limited to, personally identifiable information. Entrant hereby submits to the collection of data by social media platforms, Sponsors, and each of their respective affiliates and sharing of such information with or by such parties. Sponsors may use such information for any lawful purpose, including, but not limited to, marketing goods and services to you. All information shared with or via a social media platform or Sponsors by Entrant in connection with this Sweepstakes will be maintained in accordance with the relevant social media platform’s privacy policy and Sponsors’ website privacy policy, which can be found at https://www.mavoutdoors.com/pages/privacy-policy.

 

Entrant consents to such social media platform and Sponsors using Entrant’s personal data as provided herein. At all times, Entrant must comply with all applicable laws, rules, and regulations, including without limitation the rules or policies which may be promulgated by Sponsors from time to time. Prize awarding is contingent on permissibility based on applicable federal, state, and local laws, rules, and regulations. Entrant is responsible to comply with all applicable federal, state, and local laws, rules, and regulations that may govern activities associated with the awarding of a Prize. Entrant is responsible for consulting with its own tax advisor and understanding any tax implications in connection with accepting a Prize.

 

1. GENERAL RELEASE AND LIMITATION OF LIABILITY: By participating in the Sweepstakes, Entrant agrees to hold harmless and release Sponsors and their representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment, and marketing agencies, website providers and hosts, social media providers, and their respective parent companies, affiliates, subsidiaries, officers, directors, agents, employees, and all others associated with the development and execution of this Sweepstakes from any and all liability with respect to or in any way arising from this Sweepstakes and acceptance, possession, use, or misuse of a Prize or any substitute prize, including but not limited to liability for personal injury, bodily injury including wrongful death, damage to property, travel related activities, and damage or loss of any other kind resulting from participating in the Sweepstakes or accepting a Prize.

 

Sponsors are not responsible for Prize quality or utility. Sponsors are not responsible for any incorrect or inaccurate information, whether caused by social media users, by any of the equipment, software, hardware, or programming associated with or used in the Sweepstakes, or by any technical or human error that may occur in the processing of submissions in the Sweepstakes. Sponsors assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications-line failure, theft, destruction, lost, late, incomplete, misdirected, unauthorized access to, or alteration of entries. Sponsors are not responsible for any problems or technical malfunction of any telephone, satellite, cable, network, or lines, computer online systems, servers, or providers, computer equipment, computer software, or failure of Entry on account of technical problems, including, but not limited to, any garbled, corrupt, or jumbled transmission, failure to capture, or any error, omission, interruption, deletion, defect, or delay. Sponsors are not responsible for user cheating or fraud by any Entrants. Any activities intended to disrupt or interfere with the proper play of the Sweepstakes or defraud Sponsors in any way will be prosecuted to the fullest extent of the law. Entrants who engage in any of the foregoing activities will be disqualified and will forfeit any prizes won. If, for any reason, the Sweepstakes is not capable of running as planned, due to, but without limitation, infection by computer virus, worm, or bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsors, that in the sole opinion of Sponsors, could corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, including the selection of a winner in a manner Sponsors deem fair and reasonable, Sponsors reserve the right, at their sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes. In no event will more Prizes be awarded than are stated in these Official Rules. In the event that, due to technical, typographical, mechanical, administrative, printing, production, computer or other errors, there are more winners than are stated in these Official Rules, Sponsors shall immediately suspend all drawings and prize awards, and Sponsors reserve the right to award any remaining Prizes (up to the total set forth in these Official Rules) in a manner deemed fair and equitable by Sponsors, such as by way of example and not by way of limitation, in a random drawing from among all eligible, non-suspect entries received up to the time of the impairment, and Sponsors shall not have any further liability to any entrant in connection with the Sweepstakes.

 

Participation in the Sweepstakes and acceptance of Prizes is voluntary and involves inherent risks. By participating, Entrants knowingly and freely assume all risks of injury, harm, or loss associated with participation in the Sweepstakes and acceptance of Prizes, including any injury, harm, or loss caused by the negligence, fault, or conduct of any kind on the part of Sponsors. These risks include, but are not limited to, those related to physical activity in outdoor and park settings, such as accidents related to rough terrain, weather conditions or wildlife encounters, and those related to travel.

 

Sponsors may modify and amend these Official Rules as they appear online from time to time during the Sweepstakes Period for clarification purposes without materially affecting the terms and conditions of the Sweepstakes.

 

Without limiting the foregoing, everything regarding this Sweepstakes, including the Prizes, is provided “as is” without warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for any particular purpose or non-infringement.

 

1. DISPUTES: This Sweepstakes is governed by and will be construed in accordance with the laws of the state of Minnesota. As a condition of participating in this Sweepstakes, Entrant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively by arbitration in Hennepin County, State of Minnesota under the Arbitration Rules and Procedures of JAMS, except that the JAMS rules for selection of an arbitrator shall not be followed if any arbitrator to be selected would not otherwise be experienced and licensed to practice law in the State of Minnesota. Further, in any such dispute, under no circumstances will Entrant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, exemplary, special, or consequential damages, including, but not limited to, reasonable attorney fees. Entrant’s sole recovery, if any, shall be Entrant’s actual, out-of-pocket expenses incurred in connection with entering this Sweepstakes, not to exceed Fifty and 00/100 USD ($50.00), and Entrant further waives all rights to have damages multiplied or increased. Any demand for arbitration must be filed within one (1) year from the end of the Sweepstakes Period, or the cause of action shall be forever barred.

 

1. GENERAL TERMS: Any attempted form of participation in this Sweepstakes other than as described herein is void. Sponsors reserve the right to disqualify any entrant found or suspected, in its sole and absolute discretion, to be tampering with the operation of the Sweepstakes; to be acting in violation of these Official Rules; or to be acting in an unsportsmanlike manner or with the intent to disrupt the normal operation of this Sweepstakes. If it is discovered that a person has registered or attempted to register more than once using multiple accounts, phone numbers, email addresses, residential addresses, multiple identities, IP addresses, use of proxy servers, or like methods, all of that person’s entries will be declared null and void and that person will not be awarded any prize that he or she might have been entitled to receive. Any use of robotic, automatic, macro, programmed, third party or like methods to participate in the Sweepstakes will void any attempted participation effected by such methods and the disqualification of the individual utilizing the same.

 

Any attempt to deliberately damage any website or undermine the legitimate operation of the promotion is a violation of criminal and civil laws. Should such an attempt be made, Sponsors reserve the right to seek damages or other remedies from any such person(s) responsible for the attempt to the fullest extent provided by law.

 

If any provision of these Official Rules or any word, phrase, clause, sentence, or other portion thereof should be held unenforceable or invalid for any reason, then that provision or portion thereof shall be modified or deleted in such manner as to render the remaining provisions of these Official Rules valid and enforceable. The invalidity or unenforceability of any provision of these Official Rules or the prize documents will not affect the validity or enforceability of any other provision. No Entrant shall have the right to modify or amend these Official Rules. Sponsors’ failure to enforce any term of these Official Rules shall not constitute a waiver of that provision and such provision shall remain in full force and effect. In the event of any conflict with any promotion details contained in these Official Rules and Sweepstakes details contained in any promotional materials (including but not limited to point of sale, television and print advertising, promotional packaging and other promotional media), the details of the Sweepstakes as set forth in these Official Rules shall prevail. All federal, state, and local laws apply. Void where prohibited or restricted by law.

WINNER(S) LIST: To receive a copy of the winner list, send a self-addressed stamped envelope and description of the specific Prize(s) to be given away to Sponsors at: Mavrik Inc., Attn: Mav’s Shootin’ From The Hip Give-Away, PO Box 232, Duluth MN 55801, within 90 days of the end of the Sweepstakes Period.
